Our firm has extensive experience advising Amutot at all stages, including during the initial analysis of the ideal form of incorporation for the Amuta and its actual founding. Once the Amuta is established, our firm provides ongoing legal services according to its particular nature, with an emphasis on the processes that will enable the organization to receive a certificate of proper management and accreditation as a public institution allowed to accept donations pursuant to tax laws.

 

Our ongoing legal services also include advising and assisting Amutot with their contractual engagements with other organizations and authorities, including those that are unique to Amutot (as providers of social services and for the purposes of granting and receiving donations) and those that are not necessarily unique to Amutot. We also work to ensure Amutot comply with the various regulatory requirements that apply to them. In addition, we advise Amutot on their engagements with government ministries for the purpose of receiving budgets and various types of support.

 

Our firm also specializes in assisting Amutot undergoing audit proceedings by the Israeli Corporations Authority, or that are in the process of rectifying deficiencies.

According to the new guidelines, until the declared state of emergency in Israel is over, NPOs (amutot and public benefit companies) may conduct activities intended to provide immediate and vital assistance during the war, even if these activities do not fall under their approved objectives.

The Israeli Supreme Court has ruled that NPOs are entitled to receive an exemption from real estate betterment levies, provided they use the proceeds from the sale of such real estate for a public purpose specified in the law.

While substantial defects were found in the nonprofit organization (amutah), the court accepted and approved a settlement. Issuing a dissolution order to the amutah would have affected a large community of people that require its services.
