Our Tenders and Projects Department represents public entities in hundreds of tender proceedings and other competitive proceedings in diverse fields. These include local and international tenders for the purchase of goods or services, consultancy tenders, construction and infrastructure tenders (via various methods, including DB, BOT, and DBOT), communications tenders, and complex technological tenders. The department also routinely advises tender committees, participates in clarification meetings, conducts negotiations, and formulates settlement arrangements.
Our Tenders and Projects Department also provides legal counsel to both local and international private entities. Services include managing preparations for and during tender proceedings, drawing up preliminary agreements and cooperation arrangements for joint ventures, analyzing and assessing engagement risks, drafting legal-professional-economic requests for clarifications, drawing up bid documents, participating in clarification meetings and hearings, and negotiating settlements.
The department further specializes in providing legal guidance during the performance of infrastructure and construction projects for public entities, private developers, and contractors at financial volumes reaching billions of shekels. Services include drafting engagement agreements for performance contractors and various consultants, preparing contract surveys, issuing recommendations and preparing applications for deviations and change instructions, analyzing and preparing timetables and demand documents in respect of delaying events, preparing final invoices, negotiating settlement arrangements, and managing contractual litigation proceedings.

Barnea: Hosting Conference on Tenders in Collaboration with ACC Israel
We hosted a conference on tenders at our office.
Several firm partners lectured, including Ronit Niederman, a partner in the Tenders and Projects Department, who discussed tender negotiation strategies, and Gal Rozent, head of the Competition and Antitrust Department, who spoke about the role of competition in tenders. Among the guest speakers at the conference was Joy Sturm, a partner from international firm Hogan Lovells, who participated in a panel with Shai Avnieli, one of our firm’s partners. Another featured guest was Gal Somech, legal advisor to the Haifa Port, who addressed the port’s privatization process.

When competing entities join forces to submit a tender offer, it reduces the overall number of entities competing for a tender. Reducing the number of competing entities may increase the market power of those participating entities against the tender holder and enable them to make less attractive offers.
