An expert in the kibbutz sector, Hagit Ben Moshe was asked to address the temporary and permanent solutions the government had offered to evacuated communities from Israel’s north and south, as well as to explain why some kibbutzim and moshavim oppose them.

Our firm represented Phoenix Mortgages (Gold) Ltd. in signing a framework agreement with the Kama Fund (from the Kibbutz Movement). As part of the agreement, Kama will provide a guarantee to Phoenix for the “gold loans” it grants to kibbutz members over the age of 60 for purchasing housing in kibbutzim. A gold loan can be repaid even after the borrower’s life expectancy and is secured by encumbering the borrower's rights in the residential property attributed to it. Israel’s housing crisis has increased the attractiveness of purchasing unimproved agricultural land. Hagit Ben Moshe, head of the firm’s Kibbutz Sector Department, was interviewed by TheMarker on the complexities of purchasing such land for investment. She shed light on the many risks that can accompany these types of deals.

Hagit emphasized in the interview that purchasing land, unlike buying an apartment, is primarily at the theory level. "In most cases, companies in this field sell you an option to rights in the land, dependent on several conditions, such as changing the land's designation and completing the planning. Unless the plan is already approved, no one can guarantee you with any certainty on when or if the conditions will be met and your dreams will come true. We've encountered several cases where people buy agricultural land based on promises from the authorities, and then the authorities back down from the plans, or even expropriate the land for themselves. If the authorities cannot provide certainty, then certainly the people in sales offices can’t either."

Adv. Hagit Ben Moshe was interviewed by TheMarker following the Israel Land Authority’s declaration that the Appeals Committee’s decision will only be considered a  recommendation and not an obligation. Hagit commented that “this decision could have far-reaching impact.”

The conference is intended for managers and chairmen of kibbutz factories and companies and will discuss expected trends in the economy and the kibbutz industry in the coming decades. Hagit’s lecture will address the expected legal challenges in light of future trends in the kibbutz industry.

Hagit Ben Moshe published an op-ed in Globes' Real Estate Supplement on a district court ruling about the regulation of agricultural land use. According to Hagit, the ruling indicates a trend of harsher enforcement and signals that all agricultural communities must act without delay to regulate land use.
