Before launching a promotional sweepstakes in Israel, make sure you have a permit

Section 225 of the Penal Law prohibits, inter alia, the holding of sweepstakes. A sweepstakes is any arrangement enabling participants to win cash, a cash equivalent or other benefit, when winning depends more on chance than on understanding or ability. Holding a sweepstakes without an appropriate permit constitutes a criminal offense, even when the sweepstakes organizer’s intention is innocent and its sole purpose is to promote its business.

Israel’s Consumer Protection and Fair Trade Authority Reduces Financial Sanctions

Mandatory Recording of Sales Conversations: Implications of Amendment to Israeli Consumer Protection Law for Businesses and Financial Institutions

Amendment 74 to the Consumer Protection Law introduces, for the first time, obligations to record sales-related conversations, retain those recordings, and provide them to consumers upon request. The amendment applies to certain transactions listed in the law where the transaction value exceeds ILS 750, or where the price is unknown at the time of the call.

An Israeli District Court imposed personal liability, jointly and severally, on the directors of a company for trademark infringement, without lifting the corporate veil. Draft Bill on Application of Israeli Law to Foreign Dealers and International Companies

The Ministry of Justice recently published a draft bill for public comments, aimed at regulating the application of Israeli law to foreign dealers who target customers in Israel. The draft bill seeks to codify trends established by Supreme Court rulings in recent years into primary legislation and to set clear rules under which mandatory Israeli legal provisions will also apply to corporations headquartered outside of Israel, when their activities actually target the Israeli market.
